Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of RapidTestMedellin.com and all related services provided by Rapid Test Medellín (“Company,” “we,” “us,” or “our”).
By booking, purchasing, or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.
1.Service Overview
Rapid Test Medellín is a brand operated by Global Health LLC, a New Mexico limited liability company.
Rapid Test Medellín provides private, mobile, at-home or in-hotel diagnostic testing services in Medellín and other locations in Colombia.
We coordinate licensed medical professionals and authorized laboratories to deliver testing services.
2.Eligibility and Use
You agree that:
- You are at least 18 years old or have legal authorization
- You provide accurate and complete information
- You will be present at the confirmed time and location
We reserve the right to refuse or cancel service if:
- Information provided is inaccurate or incomplete
- The location is unsafe or inaccessible
- The client is uncooperative or unreachable
3.Payments, Cancellations, and No Refund Policy
By completing a booking, you reserve medical staff, logistics, and time-sensitive resources.
24-Hour Notice Requirement
To cancel or reschedule, you must notify us via WhatsApp at least 24 hours before your scheduled appointment time. Requests made with less than 24 hours’ notice are classified as late cancellations.
Late Cancellations and No-Shows
The full service fee will be retained if:
- You cancel with less than 24 hours’ notice
- You are not present at the scheduled location
- You are unreachable at the scheduled time
- You refuse service upon arrival
- You provide incorrect or incomplete information preventing service delivery
Same-Day Appointments
Same-day bookings are final and non-changeable. They cannot be canceled, rescheduled, or refunded.
Dispatch and In-Progress Services
Once a medical professional has been dispatched or is en route, the service is considered in progress and non-refundable.
If the Company attempts to deliver the service and is unable to complete it due to client-related issues — including absence, inaccessibility, or refusal — the service shall be considered fulfilled and non-refundable.
Payment Authorization
By completing your purchase, you confirm that:
- You are the authorized cardholder or have authorization to use the payment method
- The charge is valid and approved by you
- You understand and accept the no-refund policy
Acknowledgment of Policies
You acknowledge that you have reviewed and accepted these Terms prior to completing your purchase.
Chargebacks and Payment Disputes
You agree not to initiate a chargeback for valid charges under these Terms. If a chargeback is initiated:
- We will submit evidence including these Terms, booking confirmation, communication records, and proof of service preparation or dispatch
- You agree to reimburse us for any fees, penalties, or costs incurred
- We reserve the right to deny future service
4.Pricing and Currency
All prices are listed and charged in USD.
If paying in another currency, your bank or payment provider will convert the amount at the applicable exchange rate. We are not responsible for exchange rate differences or additional fees imposed by your provider.
5.Medical Disclaimer
Our services are not a substitute for professional medical advice, diagnosis, or treatment. Use of our services does not create a doctor-patient relationship.
We do not guarantee:
- Detection of all infections or conditions
- Accuracy beyond laboratory standards
- Interpretation of results
You are responsible for consulting a licensed healthcare provider regarding your results. You agree not to rely solely on results provided by our services for medical decisions, and you release the Company from liability for any actions taken based on test results.
6.Test Results and Timing
- Results are delivered electronically to the email provided
- Timeframes are estimates, not guarantees
- Delays may occur due to laboratory processing or external factors
We are not liable for delays or consequences resulting from delayed results.
7.Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, or consequential damages
- Our total liability is limited to the amount paid for the service
This includes, but is not limited to:
- Delayed results
- Missed diagnoses
- Misinterpretation of results
- Scheduling or logistical delays
8.User Responsibilities
You agree to:
- Provide accurate personal and medical information
- Follow all instructions from medical staff
- Ensure safe and appropriate access to your location
Failure to comply may result in cancellation without refund.
9.Prohibited Uses
You agree not to:
- Use services for unlawful purposes
- Impersonate any person or entity
- Interfere with or disrupt our operations
- Violate any applicable laws or third-party rights
10.Indemnification
You agree to indemnify, defend, and hold harmless Rapid Test Medellín, its owners, employees, contractors, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising from:
- Your use of the services
- Your violation of these Terms
- Any inaccurate or false information provided by you
- Any dispute or chargeback initiated by you
11.Dispute Resolution and Arbitration
Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the services provided shall be resolved by binding arbitration.
Arbitration shall be conducted in the United States in accordance with the rules of the American Arbitration Association (AAA) or a comparable arbitration provider.
No Court Proceedings
You agree to waive the right to bring claims in court, including the right to a jury trial, except where prohibited by law.
Class Action Waiver
All disputes must be brought on an individual basis. You agree not to participate in any class action, collective action, or representative proceeding.
Exceptions
We reserve the right to bring claims in court for:
- Chargeback abuse or fraud
- Collection of unpaid balances
- Enforcement of intellectual property rights
Arbitration Costs
Each party shall bear its own arbitration costs unless otherwise determined by the arbitrator. In cases of bad faith disputes or chargebacks, the customer may be responsible for all arbitration costs.
Location and Format
Arbitration may be conducted remotely (video or written submissions) at our discretion.
12.Fraud, Abuse, and Bad Faith
We reserve the right to refuse service, cancel bookings, or take legal action in cases of suspected fraud, abuse, or bad faith disputes.
This includes, but is not limited to:
- Filing false or misleading chargeback claims
- Providing fraudulent identification or payment information
- Abusive, threatening, or harassing behavior toward staff
- Repeated no-shows or bad faith cancellations
13.Governing Law
These Terms shall be governed by and interpreted under the laws of the State of Texas, United States, without regard to conflict of law principles.
14.Legal Fees and Cost Recovery
In any dispute, claim, or proceeding arising from your use of our services or violation of these Terms:
- The prevailing party shall be entitled to recover reasonable legal fees, costs, and expenses
- If we must enforce these Terms, you agree to reimburse all associated legal and collection costs
15.Modifications
We reserve the right to update these Terms at any time. Updates will be posted with a revised Effective Date.
Continued use of our services constitutes acceptance of the updated Terms.
